These Terms govern access to and use of BowlRMS, a platform operated by Bowl Technologies. By using BowlRMS, you agree to these Terms.
Nature of the Service
BowlRMS is a cloud-based restaurant management system that enables:
- Digital menu access
- Order placement and tracking
- Staff coordination
- Payment facilitation
BowlRMS does not operate as a restaurant and does not provide food or hospitality services.
Users
2.1 Clients (Businesses)
Businesses that subscribe to BowlRMS.
They are responsible for:
- Their operations
- Staff management
- Menu accuracy
- Pricing and availability
2.2 End Customers
Customers interact with BowlRMS through a Client's environment.
BowlRMS acts only as a technology interface.
Payments and Financial Responsibility
- BowlRMS does not collect, hold, or process funds
- Payments are handled via third-party providers (e.g., MPesa, Paystack)
- Funds are transferred directly to the Client
BowlRMS is not liable for:
- Payment failures
- Delays in settlement
- Incorrect payment details provided by Clients
AI Assistant Disclaimer
BowlRMS may include an AI assistant to help customers navigate menus.
- The AI provides suggestions only
- It does not guarantee accuracy
- It does not replace human staff
BowlRMS is not liable for decisions made based on AI responses.
Acceptable Use
Users agree not to:
- Use the platform for unlawful purposes
- Interfere with system operations
- Attempt unauthorized access
- Input false or misleading business information
Data Responsibility
Clients are responsible for:
- Ensuring they have rights to all data they input
- Managing staff data in compliance with applicable laws
- Maintaining confidentiality of account credentials
Availability
We aim to provide reliable service but do not guarantee:
- Continuous uptime
- Error-free operation
Maintenance or outages may occur.
Termination
We may suspend or terminate access if:
- Terms are violated
- The platform is misused
Clients may delete their accounts at any time.
Data deletion is processed within 7 days.
Limitation of Liability
To the maximum extent permitted by law:
BowlRMS shall not be liable for:
- Business losses
- Revenue loss
- Operational disruptions
- Indirect or consequential damages
Use of the platform is at your own risk.
Indemnification
Clients agree to indemnify Bowl Technologies against claims arising from:
- Their business operations
- Customer disputes
- Misuse of the platform
Governing Law
These Terms are governed by the laws of Kenya.
Any disputes shall be resolved within Kenyan jurisdiction.
Changes to Terms
We may update these Terms periodically. Continued use of BowlRMS constitutes acceptance of updates.
